                  AN ORDINANCE TO AMEND ORDINANCE NO. 9688,
                  ENCAPTIONED AS SET FORTH HEREIN, SO AS TO
                  AMEND THE CONDITIONS.
                 
                 
                                                    
                 
                 
       	    	 SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
       CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9688,
       encaptioned:
            AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED,
            KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE TWO
            TRACTS OF LAND LOCATED IN THE 5000 AND 5100 BLOCKS OF
            HIGHWAY 58, BEING ON THE SOUTHEAST LINE OF HIGHWAY 58
            ADJACENT TO SWAN ROAD, FROM R-2 RESIDENTIAL ZONE TO C-5
            NEIGHBORHOOD COMMERCIAL ZONE, SUBJECT TO CERTAIN
            CONDITIONS.
           
       be and the same is hereby amended by deleting conditions numbered 

       1 through 8 therein and substituting in lieu thereof the 
following
       new conditions:
            1.	 Maintenance of a site-obscuring natural screen in
                 conformance with the provisions of Article V,
                 Section 1004.(1) third paragraph of the Chattanooga
                 Zoning Ordinance on tract one so as to visually
                 obscure commercial activity from the east side of
                 the property.
           
            2.	 Maintenance of a site-obscuring natural screen in
                 conformance with the provisions of Article V,
                 Section 1004.(1) third paragraph of the Chattanooga
                 Zoning Ordinance, along the east line of site 2
                 from the southernmost tip of the property north 100
                 feet to a point across Swan Road from the
                 intersection of Swan Road and Mimosa Circle.

            3.	 No store for the sale of gardening supplies and
                 equipment shall be permitted on either tract.
           
            4.	 No fence shall be erected or maintained on site 2.
           
            5.	 Ingress and egress for both tracts shall be subject
                 to the approval of the City Traffic Engineer.
           
            6.	 Drainage requirements shall be met by:
           
                 (a)  a pipe in the side ditch to Highway 58 of size
                      approved by the Storm Water Division; and
                
                 (b)  all surface water from the property shall
                      drain to a detention pond.
                
                
       	    	 SECTION 2.  BE IT FURTHER ORDAINED, That this Ordinance
       shall be effective two (2) weeks from and after its passage as
       provided by law.
